Brittany also maintains a practice in probate and fiduciary matters arising out of estates, trusts, and guardianships, and handles an assortment of real estate-related disputes, such as landlord-tenant issues, evictions, construction claims, and mechanic’s liens.

Representative Matters

  • Represented a privately owned hospital group in various business disputes and employment matters.
  • Represented a company defending claims asserted against it by a shareholder for access to books and records under the Texas Business Organizations Code.
  • Successfully defended five employees against claims brought by former employer alleging breaches of fiduciary duties, conspiracy, and misappropriation of trade secret claims.
  • Successfully represented a development company in an arbitration proceeding to remove a $500,000 mechanic's lien recorded by a contractor against the property.
  • Represented a development company and successfully obtained a summary judgment on liability and an award of specific performance related to the breach of a real estate contract.
  • Routinely represented a national bank in many aspects of creditor rights law, including the enforcement of loan documents and collection claims.
  • Represented a multi-location dental practice in bad faith claims against an insurance company involving loss of business income, loss of equipment and inventory, and reimbursement for continuing operating expenses and expenses in connection with moving dental practice to temporary locations.
  • Represented a development company asserting professional negligence and breach of contract claims against an architectural firm for errors and omissions that caused significant cost overruns during the construction of a $40 million dollar multi-family development.
  • Represented several popular Houston restaurant groups in various business disputes and employment matters.
  • Represented company asserting claims against former CEO and majority shareholder for breaches of fiduciary duties, fraud, and breach of contract.
  • Represented developer asserting claims against former business partners for misappropriation of funds and breach of contract.
  • Represented an out-of-state manufacturer defending breach of contract claims asserted against it by former supplier in bench trial.
  • Represented a national distributor in a separation with a global equipment manufacturer, claiming over $1MM was owed to it by the distributor under various distributor agreements between the parties.
  • Represented a Texas subsidiary of a Canadian company in seeking and securing permanent injunctive relief against a former employee for misappropriation of trade secret claims.
  • Represented a non-profit foundation in a will contest against a national hospital system, alleging lack of capacity and undue influence.
