In honor of Data Privacy Day, Nelson Mullins privacy professionals will host a two-day webinar on February 7-8 titled Creating a Data Privacy & Security Playbook for 2024: An Overview of Compliance and Regulations, AI, and Data Breach Concerns. In recent years, the proliferation of web tracking tools provides website operators with more focused analytics of user behaviors on operator sites, tracking interactions with users in new ways. These tools, including Meta’s Pixel Tracker and Google Analytics, have sparked increased scrutiny by plaintiffs, regulators, and class action lawyers alleging that the tools violate various privacy protection statutes — some of which are a half century old.
In this session, Nelson Mullins lawyers Steve Augustino, Mallory Acheson, Trish Markus, and Gina Greenwood will walk you through a new wave of theories advanced using federal and state wiretapping laws adopted in the 1960s, the Video Privacy Protection Act of 1988, the Health Insurance Portability and Accountability Act of 1996 (HIPAA), and the FTC’s Health Breach Notification Rule. Our experienced lawyers will discuss what these attempts to use old laws for new purposes mean for tracking technologies, online chat features, and video playback.

Not only are there more mobile connections than people currently in the U.S.,but nearly two in three households are mobile-only today. This session will address the importance of obtaining user consent to communicate via mobile and discuss the growing backlash against unlawful and nuisance robocalls and robotexts. Nelson Mullins communications attorneys Steve Augustino and Jack Pringle will offer their insights for using this essential communications channel in a legal and effective way.
In this session, Brad Rustin, who chairs Nelson Mullins’ Financial Services Regulatory Practice, along with data privacy and security specialists, Brad Moody and Ariel Cavazos, will discuss the new data privacy and security challenges facing the financial services industry in 2024. Significant changes are coming to the industry as U.S. regulators seek to create an Open Banking system and eliminate barriers inhibiting consumers’ ability to transfer their data to other institutions. The Nelson Mullins team will offer guidance about how industry members need to prepare for regulations under the new open system intended to address the inherent risks to data with widening access to a customer’s personal information. Additionally, this session will also cover what financial institutions need to do to prepare for the FTC’s new breach notification requirement coming into effect in May 2024.
