He has extensive experience across a broad range of cyber incidents, including ransomware attacks, network intrusions, business email compromises, and denial of service attacks, affecting a multitude of industries, including the healthcare, retail, automotive, manufacturing, information technology, and education sectors. In addition to his incident response practice, Brad assists businesses with risk mitigation against potential cyber events by formulating company and industry-specific policies and procedures and incident response plans, and he counsels clients in compliance with federal, state, and international privacy and security laws. Brad also has extensive litigation experience with defending healthcare providers and litigating various types of commercial disputes.

  • Regularly guides private and publicly held companies through responses to cyberattacks, which includes working with forensics teams to determine scope of incidents, advising clients on reporting obligations to state and federal authorities, and preparing consumer notifications and notices to regulatory agencies and numerous attorneys general
  • Has defended numerous pending governmental investigations of data security incidents
  • Successfully defended numerous privacy/security investigations by the Office for Civil Rights and various state attorneys general following data privacy breaches
  • Defended nationwide manufacturer and seller in class action lawsuits involving claims of fraud, breach of warranty, violations of Truth in Lending Act, and Telephone Consumer Protection Act
  • Obtained the dismissal of construction defect claims brought against a general contractor
  • Obtained the dismissal of the plaintiff's Chinese drywall claims brought against a construction company
  • Won defense award in arbitration of nursing home neglect and wrongful death case where plaintiff claimed family member died from multiple falls at facility
  • Obtained favorable settlements for several companies after working with a computer forensics expert to develop evidence of trade secret theft by former executives and sales representatives
  • Obtained a preliminary injunction on behalf of a major ATM manufacturer to prevent the use and dissemination of trade secrets by former executives of the company
  • Won a directed verdict and dismissal at trial on behalf of a long-term care provider in a stage IV ulcer and wrongful death lawsuit
