Partners Cory Manning, Rob Lindholm, and associate Wes Moran were featured in a Law360 article regarding the dismissal of a high profile Racketeer Influenced and Corrupt Organizations Act (RICO) case. University of Louisville basketball recruit Brian Bowen II brought civil claims under RICO against Adidas and others alleging defendants violated RICO when former Adidas employees and consultants offered his father a $100,000 bribe to enroll him at Louisville. Bowen further claimed that as a result of defendants’ conduct, he lost his scholarship and his ability to play for the Louisville basketball team, his NCAA eligibility, and potential future earnings as a professional basketball player.
Nelson Mullins represented former Adidas employee Chris Rivers in the case. The court dismissed the case in Rivers’s and the other defendants’ favor on grounds that Bowen lacked standing because he voluntarily relinquished his scholarship when he transferred from Louisville and the other alleged injuries were not recoverable under RICO.
