Representative Matters
- Successfully represented a series of subcontractors with nonpayment claims against a large general contractor on a series of ongoing condominium projects, which resulted in the general contractor’s surety taking over all of the Projects, paying each of the subcontractors the balance owed plus attorneys’ fees which totaled approximately $2 million across the matters, and the firing of the general contractor’s attorney who had been representing the surety under a tender. All of this happened as a result of the first deposition taken of the surety’s corporate representative.
- Successfully represented a general contractor working on a high-end luxury home in Bay Harbor Islands who was wrongfully terminated by the Homeowner and sued for over $600,000 in completion damages, prevailing in arbitration against the homeowner and obtaining an award for over $50,000 never paid to the contractor.
- Successfully represented a hotel owner in the termination of general contractor and performance bond claim against a general contractor who had filed a lien against the hotel property and its surety, obtaining $1.3 million from the performance bond surety, release of the original contractor’s lien, and a replacement general contractor from the surety.
- Successfully represented a hotel owner in an arbitration against a general contractor that had performed defective and incomplete work in the construction of a new hotel, obtaining an arbitration award of over $1.2 million against the general contractor.
- Successfully represented a hotel owner in a defective work claim against a general contractor where the hotel was suffering water damage, obtaining a settlement payment from the contractor’s insurance carrier exceeding $700,000.
- Successfully represented a landscaping maintenance contractor against a city for nonpayment, obtaining a non-binding arbitration award of $150,000 and ultimately obtaining a settlement from the city of $195,000.
- Successfully defended a general contractor and its surety sued by a sub-subcontractor for nonpayment under a public works bond, obtaining summary judgment and attorneys’ fees against the plaintiff.
- Successfully represented homeowners against a window contractor that had damaged the structure of their home during a window replacement job, obtaining a settlement exceeding $100,000.
