Experience

  • In re Testosterone Replacement Therapy Products Liability Litigation: AbbVie in national product liability litigation related to AndroGel, a prescription testosterone replacement therapy product. Nathan was co-trial counsel for AbbVie in the first three MDL bellwether trials, each resulting in no damages recovered by Plaintiffs.
  • In re National Prescription Opiate Litigation: Purdue Pharma in thousands of lawsuits involving OxyContin filed in both federal and state courts by public and private entities alleging RICO, consumer fraud, public nuisance, and negligence claims related to opioid abuse, addiction, and diversion. The opioid litigation, one of the largest in U.S. history, involved thousands of cases in 49 different jurisdictions, 160+ million pages of produced documents, 500+ fact depositions, and over 100 experts.
  • In re Takata Airbag Litigation: Takata Corporation in connection with the largest recall in U.S. history, resulting civil litigation, and investigations of airbag inflator ruptures by the National Highway Traffic Safety Administration, Congress, and the Department of Justice, among other entities.
  • In re Prempro Products Liability Litigation: Wyeth Pharmaceuticals, a subsidiary of Pfizer, in federal and state court litigation involving 15,000+ cases regarding products liability and fraud claims, including numerous trial teams that delivered full defense verdicts in both state and federal courts.
  • Former CFO of Walgreens in a high-profile defamation lawsuit that garnered significant national press.
  • U.S. Department of Justice vs. Microsoft Corporation: Microsoft in obtaining a complete victory in the remedies phase of a high-profile antitrust lawsuit.
  • Roquette v. A.E. Staley, Tate & Lyle plc et al.: Tate & Lyle plc, a UK company, and its U.S. domestic subsidiary against claims of trade secret misappropriation, RICO and Lanham Act violations filed in Iowa and New York by French company Roquette Freres and its U.S. subsidiary. Bench trial resulted in a full defense verdict.
  • In re High Fructose Corn Syrup Antitrust Litigation: A.E. Staley Manufacturing in securing a successful settlement in a nationwide antitrust class action alleging that Staley and its co-defendants conspired to fix the price of high-fructose corn syrup.
  • Leading cell phone manufacturer in an internal investigation of theft and trade secret misappropriation regarding high-value prototype smartphones.
  • Nationally recognized sports equipment manufacturer in head-injury litigation regarding claims of products liability and design defect.
  • A physician in a criminal matter regarding federal Anti-Kickback Statute and healthcare fraud claims.
