Nelson Mullins Team Joins Lawyers’ Committee in Amicus Brief to Broaden Access to Habeas Relief for Incarcerated Persons of Color
Raleigh partners Chris Blake and Martin Warf, on a pro bono basis, partnered with attorneys from The Lawyers’ Committee for Civil Rights Under Law in preparing an amicus brief supporting the Petitioner-Appellant in Hammoud v. Ma’at, United States Court of Appeals for the Fifth Circuit, Case No. 19-50914. The Hammoud case involves the interpretation of the “savings clause” in 28 U.S.C. § 2255, and when incarcerated persons in the federal system are entitled to seek habeas relief. On behalf of the Lawyers’ Committee, the amicus brief argued that a broader interpretation of the “savings clause” would allow more people of color to pursue meritorious claims of actual innocence through a petition for habeas corpus.
