In an article published by Law360, Nelson Mullins partner Steven Augustino discussed some of the present obstacles faced by the Federal Communications Commission (FCC) that might influence the Supreme Court's ruling on abandoning the Chevron doctrine.
"If Chevron is overturned, then the FCC would face a higher hurdle in justifying specific actions it might pursue," Steven told Law360. "That would place a premium on ensuring that the FCC limits its judgments to the areas that are within its traditional expertise over telecommunications and avoids as much as possible policy judgments that Congress could have made in the act itself."
