As more than a dozen states backed an amended complaint seeking to overturn the Supreme Court’s ruling on the vaccine mandate for healthcare workers, Kristin Ahr, Florida-based partner at Nelson Mullins, said this new complaint “doesn’t raise or add new legal arguments to those already submitted in the prior litigation.”
The Supreme Court’s decision allowing the CMS Mandate to proceed to enforcement was fairly clear that CMS had the authority to issue the healthcare worker mandate, she said.
