Baltimore partner Mike Brown has tried more than 100 cases to verdict in more than 20 states over the past 30-plus years. In that time, he has developed a phrase to try to get to any bias in his potential jurors: “I want to know what you’re thinking when you’re home with your people,” he tells jurors.
“Your people” has a way of injecting comfort and authenticity into a formal and potentially uncomfortable process, he says. When he can get someone to honestly express an anti-corporate sentiment, he commends them: “ ‘Thank you so much for being honest. I can’t tell you how much I appreciate that. I have so much respect for you for doing that.’ And then the next person is like, ‘Well, come to think of it, I hate corporations, too.’ “
