The Supreme Court has asked the Biden administration for its opinion on a challenge to Harvard University’s use of race in college admissions. Students for Fair Admissions is suing the school for allegedly discriminating against Asian-American applicants in its use of affirmative action in college admissions.
The Supreme Court request shows the complexity of the case, noted Washington, D.C. partner Art Coleman of Nelson Mullins’ EducationCounsel affiliate.
“It reflects that whether to take the case or not remains a close – and probably contentious – question for the court,” said Coleman, a former deputy assistant secretary at the U.S. Department of Education’s civil rights office during the Clinton administration.
