The Federal Communications Commission is accepting feedback on rules regarding removing internet service providers from a consumer discount program. The rules apply to the $14.2 billion Affordable Connectivity Program (ACP). Washington partner and communications attorney John Heitmann, attorney to a group representing providers, told Law360 that the group plans to "call out due process shortcomings in the ACP order's involuntary removal and funding hold provisions which could inhibit investment needed for small providers to continue to participate successfully in the ACP. These powers delegated to the bureau chiefs did not go through the appropriate Regulatory Flexibility Act review process and they pose a unique threat to small providers that are essential to the success of the ACP."
