Nelson Mullins Charleston partners Bart Daniel and Matt Austin authored an article with Washington D.C. partner Hannah Cross that has been published in Health Law Connections. This article, "Revisiting Tuomey in the New Regulatory Landscape," summarizes the case itself and what lies ahead following Tuomey.
In 2005, Dr. Michael Drakeford alleged that Tuomey Healthcare System had entered into contracts with referring physicians that violated the Stark Law and the FCA. Drakeford alleged that overcompensation took place under the hospital's contracts. In the following years, the case would be further dissected and negotiated ultimately leaving uncertainty surrounding the case findings.
