Promotions, Claims, and Consumer Reviews: What You Need to Know to Lawfully Promote Your Brand
Hosted by: Nelson Mullins Webinar
In this webinar, Jim Dudukovich, who co-chairs the Nelson Mullins Advertising, Marketing, Sponsorship & Promotions practice group, will provide you with helpful, up-to-date guidance on three tactics brands consistently use to promote their products and services:
-
Conducting contests, sweepstakes, giveaways, and loyalty/rewards programs
-
Making claims about your product or service (or your competitors’)
- Soliciting, collecting, organizing, publishing, and sharing consumer reviews
Each of these may look simple on its surface but is governed by a myriad of state and federal laws that can provide the basis for challenges by regulators, competitors, and the class action bar. Challenges can expose your business not only to reputational damage, but also to real financial penalties; as of today, violations of the Federal Trade Commission’s Rule on the Use of Consumer Reviews and Testimonials could result in civil penalties of up to $53,088 per violation. This session is intended to help you identify potential traps and navigate around them to build effective and compliant campaigns.
