Partner Gabriel Imperato will speak at the False Claims Act Mock Trial Institute 2024 hosted by the American Bar Association (ABA) on January 17-19 in Washington, D.C. This program revolves around a three-day mock False Claims Act (FCA) trial, from voir dire through jury deliberations that attendees will observe live and via video. Attendees will be able to discuss the trial with the attorneys, jury consultants, and mock jurors. The program will also be available for CLE credit.
Imperato will participate in Panel 2, where a panel of industry professionals will speak on the topic entitled, "Can I Do That? Ethical Concerns for Private, Relators, and Government Counsel." This panel will explore ethical issues, such as the duties that arise when defense counsel represents the company and an individual, when relator’s counsel collects evidence from a relator, or when an attorney communicates with a party represented by a company's in-house counsel. Government attorneys have their own distinct set of ethical issues and standards which they must keep in mind. Attendees will hear from experienced counsel from all sides of the FCA bar who regularly grapple with these issues and learn how they effectively manage or resolve them.
Imperato is the managing partner of Nelson Mullins' Fort Lauderdale office and the Team Leader of the Health Care Criminal and Civil Enforcement, Compliance, and Litigation Practice. He has practiced health care law in both the public and private sectors for over forty years. He is Board Certified as a specialist in health law by the Florida Bar and is also certified in Health Care Compliance (CHC) by the Health Care Compliance Association. Imperato recently served as the General Counsel of the North Broward Hospital District, the tenth largest health care system in the United States and was the Deputy Chief Counsel of the United States Department of Health and Human Services. He is also a longtime member of the board of directors of the Society of Corporate Compliance and Ethics and the Health Care Compliance Association (SCCE/HCCA) and is a past president and interim CEO of this organization.
