AHLA Annual Meeting: Paradigm Shift – New Information Blocking Rule Helps Unlock Patient Data

Raleigh partner Trish Markus will present at the American Health Law Association’s Virtual Annual Meeting June 30 from 1:30 to 2:45 p.m. She will participate in a panel entitled, “Paradigm Shift – New Information Blocking Rule Helps Unlock Patient Data.” 

The 21st Century Cures Act prohibits "information blocking" by healthcare providers, health IT developers of certified health IT, and health information networks/exchanges. Information blocking was defined in the Cures Act, and the Office of the National Coordinator for Health Information Technology was directed to develop a rule specifying exceptions to the information blocking definition. The final rule was published on May 1, 2020, and specifies eight detailed exceptions to the definition.

Seventeen years after the HIPAA Privacy Rule, the information blocking provisions represent a paradigm shift as compliance requires more disclosure of patient information. Speakers will address:

  • Conditions of the eight exceptions
  • Impact of key definitions
  • Pragmatic strategies to assist with compliance
