Government Enforcement

  • Advise clients in responding to regulatory inquiries and investigations stemming from cybersecurity or privacy incidents, including inquiries from OCR, FTC, CFPB, and State Attorneys General.
  • Defend large pharmaceutical manufacturer in criminal and civil investigations brought by the U.S. Department of Justice (DOJ) and related inquiries and enforcement actions brought by the U.S. Department of Health and Human Services Office of Inspector General (HHS-OIG) and State Attorneys General (AGs) involving claims under the Food, Drug, and Cosmetic Act and Federal Anti-Kickback Statute, resulting in favorable settlement and resolution of all claims.
  • Defend publicly traded foreign medical device manufacturer in investigation and enforcement action brought by the U.S. Securities and Exchange Commission, resulting in favorable settlement and resolution of all claims.
  • Defend individual former executive of finance company in connection with investigations conducted by DOJ, SEC, and the U.S. Commodities and Futures Trading Commission (CFTC) and related proffer meetings, resulting in the favorable categorization of the individual by DOJ in the context of these investigations.
  • Represent large bank in connection with Anti-Money Laundering inquiries and remediation stemming from the FIFA corruption scandal.

Litigation

  • Represent companies in privacy and cybersecurity-related litigation, including class actions following data breaches and claims brought under state consumer protection and data privacy statutes.
  • Coordinate privilege strategy and litigation preparedness in matters with overlapping regulatory investigations and civil claims.
  • Defend large bank in consumer financial services and employment discrimination litigation, resulting in favorable settlement and resolution of all claims.
  • Defend business owner in securities class action litigation relating to alleged promotion of cryptocurrency.
  • Represent foreign government claimant in U.S. civil asset forfeiture litigation.

Cybersecurity & Data Breach Response

  • Investigate cybersecurity intrusion and data breach for biotech company, including crafting remediation plan.
  • Review cybersecurity and data privacy components of corporate compliance programs for biotech companies.
  • Advise clients on regulatory enforcement risks following cybersecurity incidents and guide companies through breach notification obligations.
  • Support litigation teams with regulatory coordination, fact development, and response strategy in high-profile data security matters.
