Experience

  • Litigated cases involving medical and professional malpractice, products liability, mass tort, catastrophic injury, bad faith, and insurance disputes.
  • Scott’s products liability experience includes defending manufacturers, distributors, and other industry professionals in cases involving alleged defective design and manufacturing of medical devices and equipment, dietary supplements and pharmaceuticals, elevators, claims of food contamination. Scott also has handled myriad claims involving allegations of deceptive labeling of products and inadequate warnings.
  • Represented several leading financial institutions in a variety of actions, including in national and regional class action claims and multi–district litigation, as well as lender liability actions and loan servicing litigation throughout the State of Florida.
  • Mr. Knapp also has a background in sports law. Throughout law school he worked with the executive management for the Miami Heat of the National Basketball Association. Since, he has represented clients in several matters in the sports industry, including representation of a disability insurance carrier in a multimillion–dollar claim brought by a professional franchise.

Representative Matters

  • Settled two related high–exposure putative class action product liability matters concerning energy drinks with hundreds of millions of dollars demanded for only $5.00 to each of the three individual plaintiffs after the court denied class certification.
  • Secured dismissal of a high–profile claim against a Fortune 500 company claiming to have conspired with local healthcare providers to violate the Medicare Secondary Payer Act.
  • Successfully defended a regional telecommunications company from an action involving an eight–figure demand for compensatory and punitive damages resulting from alleged fraud and underpayment of commissions to an independent contractor.
  • Appeared as second chair defense counsel in a jury trial involving claims of medical negligence, fraud, and violations of FDA regulations. In this capacity, argued multiple evidentiary issues and successfully defended the client against punitive damage allegations.
  • Obtained multiple defense verdicts and arbitration awards following trials involving claims of elder abuse and nursing home negligence.
  • Achieved a favorable seven–figure settlement for a specialty care pharmacy relating to disputed claims for reimbursement.
