Richard is an experienced eminent domain attorney who currently serves as outside general counsel to the Jacksonville Transportation Authority. Richard is an experienced eminent domain attorney who currently serves as outside general counsel to the Jacksonville Transportation Authority. In that role, he is responsible for a wide variety of legal needs of the Authority, including board governance matters, transit matters, contractual matters, litigation matters, procurement matters, right of way matters, and employment related issues.

Richard has represented hundreds of landowners in eminent domain cases throughout Florida. He has been involved in many high profile landowner cases, including a settlement in excess of $6 million against the City of Orlando, and a jury verdict in excess of $1.3 million against the Turnpike Authority. He has experience representing landowners against other condemning authorities, including the Florida Department of Transportation, Orange County, and the Central Florida Pipeline Company.

Representative Matters

  • Currently serves as Right of Way Counsel for the Central Florida Expressway Authority (CFX), regarding various projects in CFX’s five–year road plan. Mr. Milian previously handled the Authority’s Western Beltway project, which required the acquisition of 167 parcels of property worth $87 million. This project represented one of the largest ongoing condemnation projects in Florida. He also represented the Authority on other noteworthy highway projects, including the Goldenrod Extension, the Maitland Extension, and the 408 Widening Project.
  • Served as Eminent Domain Counsel for TECO, Peoples Gas System and Seacoast Gas Transmission in connection with its 51–mile natural gas transmission and distribution pipeline project providing clean energy to the JEA Greenland power plant in Jacksonville, Fla. Provided a wide variety of real estate and litigation services to clients, including handling negotiations, documentation and closings of acquisitions, title and survey matters, appraisal analysis, mediations and governmental coordination of right of way, permitting, and environmental issues.
  • Has represented the Greater Miami Expressway Agency on the 836 extension project.
  • Has represented the Orange County Public School Board on various matters, including eminent domain actions relating to the acquisition of more than 80 parcels of land for the expansion of Boone High School. Also represented the School Board in regards to projects for Colonial High School, Lokonatosa Trails Middle School, and Chain of Lakes Middle School.
  • Has represented Osceola County with regard to selective “problematic” parcels for the Osceola Parkway project.
