Business-to-Business Disputes

  • Lead counsel for software company defending in arbitration against claims of breach of contract and substantial business disruption. Prevailed on motion to compel arbitration, and then on all counts following arbitration hearing.
  • Lead counsel for software company asserting claims in arbitration for liquidated damages and return of substantial advance to former customer and defending against claims of botched implementation. Prevailed on all counts following arbitration hearing.
  • Lead counsel for software company asserting claims in arbitration for liquidated damages and defending against claims of failed implementation and improper termination. Defeated TRO seeking to restore service, then resolved case on favorable terms prior to arbitration hearing.
  • Lead counsel to education company in dispute with university regarding improper termination of contract.
  • Lead counsel to international medical supplier in breach of contract dispute with vendor. Obtained summary judgment.
  • Lead counsel for commercial tenant in dispute with landlord. Obtained summary judgment.
  • Lead counsel for investment bank in multiple disputes regarding acquisitions.

Class Actions

  • Lead counsel to healthcare system in data breach class action. Obtained dismissal with prejudice at trial court level, which was affirmed by the appellate court.
  • Lead counsel to healthcare company in data breach class action.
  • Defended municipality in civil rights class action. Deposed and led Daubert briefing of plaintiffs’ liability expert, who was excluded.
  • Lead counsel to software company in TCPA class actions.
  • Defended transportation services company in BIPA class action and led motion to dismiss briefing. Plaintiffs dismissed case while motion was pending.

M&A and Fiduciary Duty Disputes

  • Defended shareholder class action arising from go-private transaction. Plaintiff dismissed case after TRO was defeated.
  • Lead counsel for acquirer in merger dispute. Merger consummated.
  • Lead counsel for buyer in post-acquisition earn-out dispute. 

Products Liability 

  • Lead counsel for medical device manufacturer. Obtained dismissal of multiple actions on pleadings or at summary judgment.
  • Defended medical device manufacturer in coordinated state court proceedings.
  • Represented pharmaceutical and manufacturing companies in multi-district litigation.
