Brady focuses his practice in the areas of commercial real estate, development and finance, where he represents developers, investment funds, asset managers, and other ‘capital stack’ parties across real estate types and asset classes in negotiation, diligence, execution and closing of conventional and non-conventional acquisitions, financings, and dispositions. He also advises sponsors, limited partners, and other project constituents in various post-acquisition activities, including entitlement, development, construction, leasing, and other pre-exit events and in related corporate governance and financial services matters. Another core focus of Brady’s practice is commercial lending and capital markets, where he represents institutional and non-institutional lenders in a variety of real estate finance transactions, including in originations, loan administration, CMBS and warehousing transactions. 

Prior to joining Nelson Mullins, Brady worked as a real estate and corporate associate at a regional law firm in Metropolitan Atlanta. Before law school, he worked as a commercial real estate professional for an Atlanta-based boutique brokerage firm that specialized in site brokerage and future development land.

Experience

Representative Transactions

  • Represented sponsor in acquisition and related servicing work for $750 million portfolio of industrial outdoor storage facilities, located in over 20 different states, with financing through a programmatic debt facility and supplementing conventional loans. 
  • Represented developer and Atlanta-based real estate investment company in the development of 1,150 acres outside Savannah, Georgia for a new Class A industrial park, inclusive of work on a $90 million single-site disposition to a national life insurance company, the financing of an adjoining site through a $100 million construction loan with a PILOT lease component, and related project servicing and corporate governance matters. 
  • Represented southeast-based REIT in acquisition of multiple ‘life-style’ retail centers located in Florida, Georgia, and North Carolina, totaling approximately $310 million.
  • Advised national bank on servicing and administration matters in various CMBS, warehouse lending, and other pooled financing transactions, including in the refinance of a $1 billion multi-state portfolio of retail centers; the securitization of 250+ multi-family term loans; and the recapitalization of a previously securitized pool of 100+ multi-family construction loans.
  • Represented Atlanta-based residential developer in phased dispositions of approximately $50 million to production homebuilders, commercial investors, and institutional users of developed and undeveloped residential land and future commercial outparcels across multiple sites in Metro Atlanta.
  • Represented Atlanta-based sponsor in $25 million disposition of in-town Atlanta, Georgia retail center with a bonds-for-title structure, and in related servicing work for retained outparcels. 
  • Represented warehouse lender in the pledge of approximately $50 million of new loans to multiple different repurchase facilities, and in related loan diligence and servicing work.
  • Advised national lender on select limited partner investments into landbank vehicles with production home builders for residential developments in various states, including Texas, California, Arizona, and Georgia.  
  • Advised Florida-based debt fund in construction loan originations of $5 to $20 million for new standalone Class A commercial and industrial developments in Georgia and Florida.
