  • Assists mass tort defendants, medical device manufacturers, and the drug/pharma and asbestos industry with Medicare Secondary Payer compliance and third party payer lien resolution and negotiation strategies, including development and implementation of global repayment modeling; Medicare reimbursement and liability considerations; MMSEA “Section 111” Medicare Reporting compliance; and strategies to address lien and third party payer liabilities associated with regulatory inquiries, recalls and litigation. Representative matters include among of the largest repayment agreements negotiated with public and private payers resulting from mass tort settlement agreements and recalls; and the development, negotiation and administration of repayment agreements with the Centers for Medicare and Medicaid Services (CMS), state Medicaid agencies and other government programs, and major domestic private insurers.
  • Advises healthcare providers on hospital-physician relationships, including employment, management and professional services arrangements.
  • Advises healthcare providers on regulatory, licensing and operational issues, including the Anti-Kickback Statute and Stark Regulations.
  • Counsels healthcare providers and technology vendors on health information privacy and security obligations under HIPAA and the HITECH Act, including responses to HIPAA breaches and audit inquiries.
  • Advises clients on healthcare IT matters and participation in Health Information Exchange (HIE) and data sharing networks.
  • Advises clients on compliance with the Department of Homeland Security Transportation Worker Identification Credential (TWIC) program.
