In a National Law Review article published Sept. 17, partner Adam Safwat and associate Kelly Hogan discuss the Delaware Chancery Court's decision to proceed with the Caremark standard claim against The Boeing Company (Boeing) Board of Directors.
The claim follows the fatal crashes of two 737 MAX airplanes, asserting that Boeing's Board of Directors failed to fulfill their Caremark duties to oversee an effective compliance program.
