Nelson Mullins partner Shahrzad Emami Shaw was recently quoted in an article for Tax Credit Advisor titled “Reshaping Premises Liability — But ‘Not A Silver Bullet’”. Shaw notes that despite new tort reforms in Florida, there are still several obstacles for entities aiming to develop affordable housing – specifically insurance increases and continued exposure to premises liability actions.
"There is a non-delegable duty to provide reasonably a safe premises, including reasonable protection against third-party criminal attacks. With drastic geographic variation in the standards for reasonably safe premises, plaintiffs can continue to use crime records as fodder for a premises liability action against affordable housing developers,” says Shaw.
