Germany’s Sweepstakes Casino Gold Rush: What’s Driving U.S. Operators East

In an article published in Sports Betting Operator on October 30, Nelson Mullins attorneys Katherine Baker, Joshua Kirschner, and Samantha Ahearn explained why U.S. sweepstakes casino operators are increasingly expanding into Germany amid tightening domestic regulation.

“Perhaps the most compelling factor is Germany’s relatively structured and predictable regulatory environment, especially when contrasted with the fragmented and inconsistent approach in the U.S.”

They emphasized that while Germany’s dual-currency model for sweepstakes remains in a gray area, regulators there have not yet moved to restrict it, offering operators a degree of flexibility absent in the U.S. They concluded that Germany’s balanced approach could serve as a model for how the United States ultimately regulates sweepstakes casinos once current legal uncertainty subsides.

"If history is any guide (see DFS 2.0), we expect this is ultimately where the U.S. will land with sweepstakes casinos when the upheaval inevitably subsides."
