Fla. Law Firm Escapes Data Breach Class Suit

A federal judge in Florida tossed a proposed class action suit defended by Nelson Mullins attorneys Mark F. Raymond, Jennifer Winkler, Katy Spicer and Marc Williams on Monday, November 2.
An article published by Law360 noted that U.S. Supreme Court and Eleventh Circuit precedent made clear that a threat of misuse of sensitive information was not enough for Article III standing to bring a suit, relating to a data breach in May at Miami-based national law firm Zumpano Patricios P.A.
Raymond saluted U.S. District Judge Beth Bloom's "excellent analysis of the issues presented and, in the end, her recognizing that the plaintiff's case was meritless."
"This is an important victory in an era of heightened cyber attacks on our institutions," Raymond added. "Zumpano Patricios is pleased with the win in this case, and hopes it creates precedent for other American businesses that have had to and will have to combat cyber attacks."
