Kevin advises and represents companies in complex matters arising out of business and contractual disputes, toxic torts, governmental investigations, and industrial accidents. Kevin has prosecuted and defended clients in dozens of litigation matters, including cases in state and federal courts at both the trial and appellate level. He also has experience with arbitrations and with matters pending before regulatory agencies and zoning hearing boards, as well as criminal grand jury investigations. His commercial practice includes complex contractual disputes, oil and gas litigation, business torts, class action defense, real estate title disputes, equipment lease disputes, royalty disputes, franchise disputes, deal-based litigation, and high stakes public nuisance and personal injury cases.

Kevin also has a robust pro bono practice, including representing clients in the U.S. Court of Appeals for the Third Circuit involving First Amendment and immigration issues.

Experience

  • Obtained complete dismissal with prejudice on initial motion on behalf of natural gas exploration and production company of multi-count complaint filed by former lessor of oil and gas rights in Pennsylvania state court, alleging claims of breach of contract, fraud, conversion, and unjust enrichment
  • Represented an electric utility in a lawsuit filed by a coal supplier alleging breach of multi-year coal supply agreement
  • Successfully represented oil and gas producer in defending against challenge to operations and issuance of zoning permits for a compressor station
  • Represented a seller of more than $400 million in oil and gas leases in a post-closing dispute involving breach of contract, quiet title, and other claims in Pennsylvania and Texas
  • Represented a Marcellus Shale operator in obtaining resolution of misdemeanor environmental criminal charges following a grand jury investigation
  • Member of trial team that obtained a $126 million verdict on behalf of telecommunications company incident to sale of enterprise
  • Member of trial team that obtained a complete defense verdict on behalf of a steel manufacturer in a breach of contract action asserted by a buyer and reseller of coking coal following five years of litigation
  • Defended an oil and gas operator in case involving public nuisance and personal injury claims relating to alleged chemical exposure
  • Defended a public utility against personal injury claims arising out of an industrial accident at one of the company’s power plants
  • Represented a client before the Federal Energy Regulatory Commission involving the sale of a wind farm facility
  • Represented a mortgage servicer in a class action alleging violations of the Pennsylvania Unfair Trade Practices and Consumer Protection Law
  • Represented a chemical company before the U.S. Chemical Safety and Hazard Investigation Board in a matter arising out of an alleged release of chemical substances
