A Nelson Mullins team successfully obtained a judgment on behalf of plaintiff MGK International DWC LLC, one of the largest exporters of scrap metal in North America. The plaintiff brought an action for breach of contract, deceptive trade practices, fraud, and misrepresentations among other causes of action in New York against a supplier and its owner for failure to perform under multiple scrap metal purchase agreements, where the materials were supplied by the plaintiff to end customers in Asia.
Following a trial on damages—known in New York as an inquest—the court awarded the plaintiff actual and compensatory damages for lost profits with interest along with attorneys’ fees and costs.
Nelson Mullins partner Harsh Arora led this business litigation, with key support from associate Efraim Adler. The team successfully established through evidence and witness testimony that the plaintiff was entitled to full recovery, securing a significant and complete win for the plaintiff.
