Jon Sale, co-chair of Nelson Mullins’ white collar practice, was featured in a Law 360 article about the five key trends white collar attorneys should have on their radar for the remainder of 2025. The article covers the uncertain future of some major enforcement areas including the Foreign Corrupt Practices Act (FCPA), crypto, and voluntary self-disclosure of corporate wrongdoing.
On FCPA enforcement, Sale noted that a new factor the Department of Justice (DOJ) will consider is the need for U.S. companies to compete in foreign markets. He said, "You're almost going to have to be an economist or even have to have an economist on the team to look at the market and at what foreign companies are doing in terms of the competitive atmosphere,” he said.
Regarding crypto enforcement, Sale said, "The signal has gone out that it's not the Wild West in crypto, and prosecutors are going to be charging in this space."
He went on to offer insight into how ramped-up clemency actions are changing how lawyers approach the government and craft defense strategies. Sale said, “It’s never been on the radar screen before whether or not someone was going to get clemency, but if a prosecutor now thinks there could be clemency, they should really pause before proceeding with that case."
