Health Attys Face Noncompete Ban Keep Calm, Carry On

The sweeping federal ban on nearly all noncompete restrictions has sparked questions and concerns among those in affected industries, particularly healthcare. Ahead of its implementation, which is already mired with legal challenges, industry lawyers are busy navigating through the widespread uncertainty and the implications of the ban, particularly what it means for clients.   

Nelson Mullins healthcare and antitrust partner Carrie Hanger weighed in on the issue in a Law360 article published on April 30. When it comes to existing noncompetes, Hanger elaborated on how she’s currently advising clients, and was quoted in the following excerpt, in part: 

“Organizations should "make sure that any restrictive covenant they have is truly narrowly tailored for the purpose”….Hanger said the initial advice she's giving clients is to evaluate all their current contracts to see how they can potentially make revisions as necessary "in a way that would not run afoul of the rule."
