2022 Trials to Watch: Opioids, Oracle and Theranos Redux

In a Law360 analysis of the biggest trials of 2022, Kate Helm, partner at Nelson Mullins, discusses the nation’s largest multidistrict litigation involving more than 272,000 pending claims against 3M from military service members maintaining they suffered hearing loss and other adverse conditions after using military-issued earplugs made by the company. In the article, Helm said while there is a usually large number of bellwethers overall, “this appears to be very fact-driven litigation,” she said. Helm went on to explain that hearing loss claims are unique because “there is nothing broken that you can see on, for example, an x-ray. No surgery has been performed,” making the case subjective.
