Connecticut Bankruptcy Ruling Furthers Limitation Extension Split
Partner Shane Ramsey recently published an article in Law360 analyzing the ongoing debate surrounding the interpretation of Bankruptcy Rule 9006(b) and its applicability in extending statutes of limitations within various sections of the U.S. Bankruptcy Code.
Courts are split on whether this rule may be used to extend the limitations period set forth in various Bankruptcy Code sections given the omission of the word "statute" from the text of Rule 9006(b), which only refers to enlarging time set forth in the rules, Ramsey wrote.
Recent decisions, including one from the U.S. Bankruptcy Court for the District of Connecticut, further solidify this split, emphasizing the importance of procedural considerations and the potential use of equitable tolling when seeking deadline extensions.
