Nelson Mullins partner Brad Rustin, chair of the firm’s Financial Services Regulatory Practices, will speak at the 2022 BSA Experience in a presentation titled “Higher Risk Businesses: Marijuana Related Businesses, Hemp, CBD, and Cryptocurrency.” The presentation will examine high risk customers of banks, in particular those customers that participate in legally ambiguous industries—cannabis, marijuana, and cryptocurrency/digital assets. In each of these cases, customers of the bank could operate legally or illegally.

The presentation will also focus on proper bank oversight, BSA/AML obligations, and understanding the legal landscape of these fast-developing industries. Most importantly, the presentation will focus on building knowledge to properly understand the risks associated with the industries, the legal frameworks in which they operate, and what this means for a bank that chooses to either bank or not bank these industries.
