Atlanta partner Erika Birg joined Richard D. Faulkner, FCIArb., arbitrator, attorney, and former professor of ADR law, in a Federalist Society discussion of Morgan v. Sundance. The U.S. Supreme Court decided the case on May 23, 2022 in a rare 9-0 decision in which the Court vacated and remanded the judgment of the U.S. Court of the Appeals for the Eighth Circuit, holding that federal courts may not adopt an arbitration-specific rule conditioning a finding of waiver of the right to arbitrate on a showing of prejudice to the other party.
Birg serves litigants in early neutral evaluation, mediation, and arbitration as a neutral. She serves on the Large and Complex Case Panel for the American Arbitration Association and regularly serves as the sole arbitrator or chair of three-person arbitration panels.
