Partners Robbie Foster and Sarah Eibling explored the various possible bases for legal liability when acts of violence occur in the workplace and on other premises at the 27th Annual Threat Management Conference held by the Association of Threat Assessment Professionals. At the 'Frontiers of Liability in Workplace Violence: Mass shootings, and litigation arising from them, appear to be on the increase' seminar, Foster and Eibling presented fact patterns drawn from recent cases and described approaches that claimed the alleged negligence of employers and other proprietors which resulted in harm to their clients. The pair also discussed the impact of workplace violence programs--or their absence--on potential liability, future directions for litigation in this area, and approaches for minimizing liability risk.
