Recent Developments in Kickback and Stark Law

Nelson Mullins Riley & Scarborough LLP is a sponsor of the 33rd Annual National Institute on Health Care Fraud hosted by the American Bar Association (ABA) on May 3–5 in-person. Fort Lauderdale managing partner, Gabriel Imperato, is the Program Chair and has held this role for over 28 years and will also be involved throughout the event. Imperato will speak in the following sessions:

  • "Effective Corporate Compliance Programs," a discussion on applicable standards for assessing the effectiveness of compliance programs for health care organizations.
  • "Workshop 2: EKRA Enforcement: Recovery and Laboratory Industry," a discussion on recent settlements and case law applying the Elimination of Kickbacks in Recovery Act (EKRA).
  • "Specialty Workshop for Defense and In-House Counsel," a discussion on the application of the Anti-Kickback Statute in the decisions in U.S. v. Holland and U.S. ex rel. Fesenmaier v. The Cameron-Ehlen Group and investigation in trial issues and the outcome of the case.

Nashville partner Bob Wade will be a co-panelist in the "Developments in Stark and Anti-Kickback Cases," a discussion on the developments in criminal, civil and administrative enforcement actions involving the Stark law and the Anti-Kickback Statute.
