Stark Integrity Podcast
Charleston partner Bart Daniel joined Nashville partner Bob Wade on Wade’s podcast, “Stark Integrity,” to discuss the groundbreaking Tuomey case which Daniel tried and served as lead counsel. The case resulted in a $237 million False Claims Act judgement against Tuomey, a rural South Carolina Hospital, for violating Stark Law and illegally billing the Medicare program for services referred by physicians with whom the hospital had improper financial relationships.
Their discussion details the case, how it evolved into a bigger case than anticipated, and addresses pinnacle issues on what can go wrong within an organization.
Daniel emphasized three key takeaways from the discussion: Don’t dig the hole deeper, obtain one appraisal of a reputable firm and stick to it, and settle a False Claims Act case whenever possible.

Daniel is the co–chair of the firm’s white collar crime defense and government investigations team and a first–chair veteran trial lawyer. He focuses his practice on both complex commercial and white-collar litigation, along with government and internal investigations.
