Eli Poliakoff is a partner of Nelson Mullins Riley & Scarborough LLP who practices in Charleston in the areas of healthcare, privacy and information security, and maritime law.

Mr. Poliakoff advises clients on healthcare regulatory and compliance matters, including health information privacy and security obligations; HIPAA and HITECH Act compliance including HIPAA breach notification obligations and HIPAA Audit responses; referral, fraud and abuse issues including compliance with the Anti-Kickback Statute and Stark Regulations; health information technology contracting issues; and corporate and operational issues related to the healthcare industry.

Additionally, Mr. Poliakoff counsels clients on Medicare Secondary Payer ("MSP") requirements, including the "Section 111" Medicare Secondary Payer Reporting Rules, MSP billing guidelines, and MSP issues for litigants and prospective litigants.  He assists a wide spectrum of industries with MSP compliance, including healthcare providers, medical device manufacturers, entities subject to product recalls, and product liability and asbestos defendants. He is a frequent author and speaker on MSP-related issues and compliance strategies, including:

In addition, Mr. Poliakoff counsels clients on compliance with transportation and maritime security regulations, including the Department of Homeland Security's Transportation Worker Identification Credential (TWIC) program. He is a frequent speaker on the TWIC program. 

Mr. Poliakoff is a member of the American Health Lawyers Association and the South Carolina Bar.  He serves on the Harvard Alumni Association Board of Directors as the Director for South and North Carolina, and as a mayoral appointee to the Charleston Municipal Election Commission and Charleston Redevelopment Fund.  He is listed as a Rising Star in South Carolina Super Lawyers for his work in healthcare law (2012).  Prior to joining the Firm, Mr. Poliakoff served as a law clerk for Chief Judge David C. Norton of the United States District Court for the District of South Carolina, Charleston Division.  

Mr. Poliakoff earned a Juris Doctor from the University of South Carolina School of Law, where he received the Compleat Lawyer Award for his graduating class and served as Editor in Chief of the South Carolina Law Review.  He earned a Bachelor of Arts degree in Government from Harvard University in 2000, and serves as president of the Harvard Club of South Carolina.  Mr. Poliakoff received the Firm's Edward W. Mullins, Jr., Excellence in Marketing Award in 2011 in recognition of marketing initiatives.
