  • Defended a financial institution in first case in which U.S. Court of Appeals for the Fourth Circuit squarely addressed Fair Credit Reporting Act (FCRA) preemption of state-law claims
  • Represented financial institutions in cases involving federal statutes and regulations—including the Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), Truth in Lending Act (TILA), and Home Affordable Modification Program (HAMP)—and state common-law and statutory claims—including claims for breach of contract, fraud, and negligent misrepresentation, and claims under the North Carolina Unfair and Deceptive Trade Practices Act, the North Carolina Debt Collection Act, and North Carolina's materialmen's lien statutes
  • Represented lenders in connection with commercial and consumer non-judicial foreclosure proceedings and in multi-million dollar actions to recover on secured and unsecured commercial notes and guaranties
  • Represented insurance companies in litigation concerning coverage under commercial general liability, life, and title insurance policies
  • Represented businesses in merger-and-acquisition-related litigation and arbitration
  • Represented partners and joint venturers in partnership and venture litigation and arbitration
  • Defended international entertainment company against negligent hiring and retention lawsuit
  • Represented national department store chain, transportation logistics company, and furniture retailer in various franchisor-franchisee lawsuits and arbitration proceedings
  • Represented hospitals in lawsuits and arbitration proceedings against physicians and medical practices, pursuing breach of contract claims and defending counterclaims alleging breach of contract, misrepresentation, unfair trade practices, and violation of federal anti-kickback laws
  • Represented businesses in commercial contract disputes
