For more than 20 years, Ms. Wooten has assisted clients in solving litigation matters involving complex toxic tort issues, private party disputes, and administrative penalty matters. She has appeared and argued before federal, state, and administrative courts and commissions, including the Supreme Court of North Carolina, the North Carolina Office of Administrative Hearings, and the North Carolina Environmental Management Commission. Ms. Wooten also negotiated one of the first prospective purchaser agreements under the Environmental Protection Agency (EPA) Brownfields Initiative. Before law school, she was an environmental protection specialist at EPA’s Office of Solid Waste, where she wrote portions of the 1990 Toxicity Characteristic Rule and served as Co-Chairperson for the FIFRA / RCRA Policy Issues Committee.

Experience

  • Environmental and sustainability counseling and representation of a major, nationwide reverse logistics company on a range of issues involving hazardous waste material transport and handling, pharmaceutical drugs and medical devices, tobacco and alcohol, and environmental permitting
  • Represented a number of companies in a large group of parties regarding hazardous waste disposal and Superfund issues at a bankrupt waste disposal site
  • Representation and environmental advising of construction company on a range of environmental matters, including asset sale of major subsidiary and regulatory issues with state agencies
  • Served as U.S. Legal Agent for international drug packaging manufacturer for all matters involving drug master file submissions, inquiries, and other communications with the U.S. Food and Drug Administration and Health Canada
  • Advised and assisted numerous clients in evaluation of environmental condition of property and identification of creative solutions to allocate and manage environmental issues to allow transactions to proceed
  • Environmental representation and counseling of long-standing real estate and private equity investment company in numerous transactions and general business matters, including the sale of its 21-theater, 230-screen movie theater division to Regal Cinemas after seventy years of continuous operation
  • Served on team as joint defense counsel for 12 major oil companies in an environmental ligation case involving claims of nuisance, trespass and negligence, medical monitoring, diminished property value, and strict liability. The attorney team defeated class action certification and defended claims of property devaluation
  • Defended chemical company in administrative action for alleged violation of Toxic Substances Control Act and provided advice and counsel in preparing in-house compliance program
  • Has lectured and authored presentations on a variety of environmental topics, including the Toxic Substances Control Act, Superfund, RCRA, Brownfields, Drug Master File Management, and Sustainability in the retail, consumer goods, and reverse logistics industry
