Experience

  • Represents mortgage and mezzanine lenders, loan servicers, and developers in all real estate finance matters, including new loan closings, securitizations, modifications, assumptions, and defeasances; practice also includes asset-based and cash flow lending
  • Assists lenders and borrowers with transactions relating to distressed commercial loans, including restructurings in and out of bankruptcy, purchases and sales of loans and bank-owned (REO) properties, and remedy enforcement
  • Handles acquisitions, development, leasing, and dispositions of office, retail, multifamily, and residential subdivision projects

Representative Transactions

  • Representation of special servicer in restructuring out of Chapter 11 bankruptcy of portfolio of loans secured by retail properties throughout the Southeast, together with subsequent assumptions and modifications of loans
  • Representation of mortgage lender in restructuring of secured and unsecured debt by means of equity takeback of property-owning borrower entities, followed by origination and securitization of new loans on office properties in twenty-two states
  • Representation of developer in restructuring of mortgage and mezzanine debt on office building in Atlanta
  • Representation of developer in real estate and finance aspects of project finance transaction to build, develop, renovate, and manage privatized family housing at San Antonio, Texas, air force base
  • Representation of ground lessee in sale of interest in military 'BRAC' (Base Realignment and Closure) property consisting of hundreds of residential units and more than one hundred acres of land at Brunswick, Maine naval air station
  • Representation of lender in A and B mezzanine loans secured by pledges of equity interests in multiple owners of new mixed-use development
