Denver partners John P. Streelman and Mark T. Clouatre represented FCA US LLC in a contract dispute affirmed in the automaker’s favor by the U.S. Court of Appeals for the Ninth Circuit.
A San Jose, California, Chrysler dealership alleged that the company coerced them into paying a higher rate for rent. The court affirmed the prior decision made by U.S. District Judge Lucy Koh that Fiat Chrysler’s assertion to increase rent was made in good faith, having not violated the terms of the lease.
“Implementation of mutually agreed-upon contractual terms does not constitute a lack of good faith,” the panel said.
The dealership, Stevens Creek Chrysler Jeep Dodge, was also involved in a separate litigation against FCA in 2016.
