Nelson Mullins Attorneys Featured in Forbes Article Discussing FinTech Sandboxes


Partner and Chair of Nelson Mullins’ FinTech and Regulation practice Richard Levin, partner Brandon Neuman, and senior associate Jeff Kelly were recently featured in a Forbes article exploring how regulatory sandboxes are giving certain states an edge as they compete to attract innovation and investment. The article highlighted the attorneys’ recent National Law Review publication, “Hardly Child’s Play: North Carolina Joins the Growing Number of States With a FinTech Regulatory Sandbox,” which was originally presented on the firm’s FinTech blog.

Forbes referred to their article and discussed the idea of regulatory sandboxes, which are an increasingly popular way for regulators to balance the need to foster innovation while protecting the public from harm caused by untested products or services. Focusing on the rapid development of emerging technology in the financial services and FinTech industry, Levin, Neuman, and Kelly explained that “[r]egulatory sandboxes often reduce the barriers to entry for entrepreneurs and enable them to safely test and iterate on a solution before they invest considerable resources to scale their offerings.”

The article also drew from their observations about the benefits that sandboxes provide for regulators, including an increased opportunity to gather empirical data about new business models and use an evidence-based approach for future policy decisions. “This approach can validate or dispel regulatory concerns about an innovation’s impact and assist regulators and businesses in delivering beneficial services to the marketplace,” they wrote. 

An electronic trading and Wall Street veteran, Levin was one of the first lawyers to focus on the regulation of blockchain and digital assets. He is considered a thought leader in the FinTech space. Chambers and Partners has recognized him as one of a select group of attorneys in the FinTech, blockchain, and cryptocurrency space. He is a frequent speaker at conferences on FinTech and regulatory issues and is the co-author of several chapters of books on U.S. regulation of digital assets and blockchain technology.
