In an article published on May 31, 2023 in HR.com’s HR Legal and Compliance, Mitch Boyarsky discusses the changes taking place within the National Labor Relations Board (NLRB) under the leadership of Jennifer Abruzzo, their general counsel and how it can impact businesses.
“Employers should pay careful attention to the 15 issues identified in Abruzzo’s March 2023 General Counsel Memorandum (23-04), such as an attempt to expand Weingarten rights (or the right of an employee to have a union member attend a pre-disciplinary interview) to include a right to access certain information prior to the interview, including the questions to be asked during the interview,” said Boyarsky. “Given the heightened risk presented by these issues and the constantly evolving nature of board law, employers should be particularly aware of these areas and contact their legal compliance team for further guidance in complying with current and, at times evolving, board doctrines.”
