For people in the legal profession, implicit bias — the way people unconsciously assess each other — is especially important to pay attention to. Columbia associate Amber Hendrick recently spoke on the Implicit Bias panel at the S.C. Bar Annual Judicial Conference's Staff Attorneys and Law Clerks Seminar, giving perspective on how these kinds of assumptions have surfaced in her personal and professional life.
Other panelists shared their own experience with implicit bias while Beth Ruffin, a diversity and inclusion consultant, moderated. The panel also explored how implicit bias can play into sentencing decisions, trying and approaching the jury, and how law clerks make recommendations to judges. Hendrick, who served as a judicial clerk to Kendra Y. Ausby, Margaret B. Seymour, and J. Michelle Childs, left law clerks and staff attorneys with the advice that checking their own biases can ensure their recommendations are based in facts rather than unconscious judgments.
