Try West Virginia Pfizer Hormone Therapy Case


CHARLESTON, W.Va. (Aug. 26, 2011) - A defense team including Managing Partner David Dukes and Columbia partner Mark Jones defended two Pfizer subsidiaries in a lawsuit in West Virginia alleging their hormone therapy medicines caused a woman's breast cancer.
The defense verdict came in the U.S. District Court of West Virginia and marked five out of six recent jury victories for Pfizer and its subsidiaries, Wyeth and Upjohn. The plaintiff was diagnosed with deep vein thrombosis in April 1999 and breast cancer three months later. She filed a lawsuit against the Pfizer subsidiaries on July 7, 2004, alleging that the hormone therapy drugs Premarin, Prempro, and Provera caused her DVT and breast cancer. She later withdrew her claims relating to DVT. The jury trial lasted approximately three weeks, and the jury deliberated less than a day before deciding that the plaintiff had not proven that the medication caused her breast cancer. The jury also concluded that plaintiff had not filed her lawsuit within the applicable statute of limitations period.
Mr. Dukes, Mr. Jones, and this trial team have also been involved in obtaining defense verdicts for Pfizer subsidiaries in jury trials in Philadelphia and Little Rock in the hormone therapy litigation.
