Certificate of Need Practice
Nearly half of the fifty states have Certificate of Need (CON) laws, although requirements vary widely from state to state. Nelson Mullins' CON lawyers work with clients to plan strategically for projects that may require CON review or that qualify for CON exemption. We also assist clients in evaluating the merits of competitor CON projects and assessing the strategic considerations of intervening in such projects.
Our attorneys have longstanding relationships with health planning consultants with whom we work closely to develop effective CON applications. We also serve as agency liaisons for our clients during the administrative review process, a particularly important role during competitive reviews.
