Nelson Mullins has regularly provided counsel to our clients throughout many real estate cycles, and we are acutely aware that market factors influence the performance under real estate collateralized loans.  Our team understands the purpose and structure of workout agreements, from both a lender and borrower perspective and are experienced with loan modification agreements, structured settlements, workouts, and “prepackaged” Chapter 11 plans. Our involvement has contributed to the ultimate recovery or retention of assets in many “troubled” situations. Through the combined efforts of our banking, real estate, and bankruptcy groups, our team of attorneys negotiates, structures, and drafts workout agreements involved in a variety of real estate collateralized loan transactions.  Our team also has represented investors in acquiring distressed real estate properties and loan portfolios in transactions with lenders, as well as lenders in the restructuring, enforcement, and sale of distressed debt loan portfolios.
