Rose-Marie T. Carlisle is of counsel to Nelson Mullins Riley & Scarborough LLP in Columbia where she practices in environmental law and litigation. Ms. Carlisle holds memberships in the District of Columbia Bar and the state bars of New Hampshire and South Carolina.
Having practiced for more than 20 years in the environmental arena, Ms. Carlisle's experience includes advising clients on environmental liabilities in real estate and corporate transactions as well as Clean Water Act permitting and CERCLA cost recovery/contribution litigation. Her CERCLA work has involved sites in Alabama, Florida, Georgia, New York, North Carolina and South Carolina, where she has participated in de minimis settlements, mediation sessions, and litigation involving diverse issues, including the CERCLA liability of a dissolved corporation.
Ms. Carlisle has represented industrial clients in Georgia and South Carolina in enforcement actions under the Emergency Planning and Community Right-to-Know Act. She has represented South Carolina industrial clients in enforcement actions under the Clean Water Act, S.C. Solid Waste Policy and Management Act, and other state and federal environmental statutes. Her experience includes negotiation of alternative standards for the control of toxics in industrial wastewaters for clients with NPDES permits.
Prior to joining the firm, Ms. Carlisle's practice in Washington, D.C. centered on a range of issues affecting the oil and gas industry under the Clean Water Act, the Oil Pollution Act of 1990 and the Resource Conservation and Recovery Act. There, she counseled on Clean Air Act questions involving wastewater treatment facilities on behalf of oil and gas industry clients. Ms. Carlisle managed the audit of one of the largest industrial facilities in the United States, in which the company anticipated a series of audits by state and federal regulatory agencies and investigations by congressional committees.
Before entering private practice, Ms. Carlisle was an Assistant Attorney General for the State of New Hampshire. Ms. Carlisle is a member of the American Bar Association and its Natural Resources, Energy and Environmental Law Section, the Environmental Law Institute, and the South Carolina Women Lawyers Association.
Ms. Carlisle has published several works on environmental issues, including "The Impact of CERCLA on Real Estate Transactions," S.C. ENVTL. L.J., Fall 1995.
Ms. Carlisle earned a Juris Doctor from the University of Virginia School of Law in 1983 and a Bachelor of Arts in Anthropology, with Distinction, from the University of Virginia, College of Arts and Sciences in 1978.
