Kenneth A. Janik is a partner of Nelson Mullins Riley & Scarborough LLP in Columbia where he practices in the areas of taxation, ERISA and employee benefits, and corporate law. Mr. Janik is certified by the Supreme Court of South Carolina as a tax specialist.

Mr. Janik has worked extensively with employee benefits, including qualified and non-qualified profit sharing, pension, multiple employer plans (MEPs), and other retirement plans, health, accident, disability and other welfare plans, employee benefits-related taxation matters, executive compensation, stock options, restricted stock, phantom stock, equity, synthetic equity, and similar compensation, LLC profits interests, golden parachute issues, non-qualified deferred compensation, 409A issues, ERISA, Internal Revenue Code, COBRA, employee benefit plan design and modification. He has counseled clients on compliance with Internal Revenue Service and U.S. Department of Labor regulations and pronouncements. He works with clients on employee benefits matters in the context of mergers and acquisitions, disputes involving employee benefits, and planning and developing strategies to avoid disputes.

Mr. Janik has worked extensively with matters related to economic development incentives, state and federal tax-related planning, and disputes.  He also has extensive experience in South Carolina state and local tax matters, including income, sales, use, property tax, and fee-in-lieu of property tax.

His practice involves the representation of a large number of publicly held and private organizations, governmental agencies, and corporations from the technology, manufacturing, and health care industries.

A member of the South Carolina Bar, Mr. Janik is admitted to practice before the U.S. Tax Court, the 4th U.S. Circuit Court of Appeals, and the U.S. District Court for the District of South Carolina. Mr. Janik has served as adjunct professor for the Moore School of Business at the University of South Carolina, and he frequently speaks at educational seminars on a variety of legal issues. Mr. Janik is a member of the American Bar Association (Corporate Law and Tax Sections; Employee Benefits Committee), the Richland County Bar Association, and the S.C. Economic Developers Association.  He is listed in The Best Lawyers in America (Employee Benefits Law and Tax Law Sections, 2003-2012 editions).

Mr. Janik earned a Master of Laws in Taxation from the Levin College of Law at the University of Florida in 1987. He earned a Juris Doctor from the University of South Carolina School of Law in 1984, and a Bachelor of Arts from the University of South Carolina in 1979. As part of his undergraduate study, Mr. Janik attended Warwick University in the United Kingdom as an economic history exchange student.
